Norfolk Bankruptcy Court

The U.S. Bankruptcy Court for the Eastern District of Virginia maintains the Norfolk Division to serve southeastern Virginia. The court is physically located in Norfolk and handles Chapter 7, Chapter 11, and Chapter 13 cases for residents and businesses in Norfolk, Portsmouth, Chesapeake, Virginia Beach, and Suffolk. Call (757) 222-7500 during business hours to reach the clerk's office. The Eastern District's chief judge is Hon. Brian F. Kenney.

Chapter 7 cases let individuals discharge most unsecured debts after liquidating non-exempt assets. Chapter 13 allows debtors to keep property while repaying creditors through a court-approved plan over three to five years. Chapter 11 is the option for businesses or complex individual cases. Every petition filed with the court gets a case number that tracks the case from initial filing through discharge or dismissal.

Norfolk Circuit Court Records

Norfolk Circuit Court is the state court for the city. It handles civil cases over $25,000, all felony criminal matters, family law, land records, and appeals from lower courts. The clerk's office at 150 St. Paul's Blvd. maintains court records including civil case files, land records, and marriage licenses. These records come into play during bankruptcy cases when trustees or creditors research a debtor's financial picture. Records are generally public under Virginia law unless sealed by court order.

In-person access to Norfolk Circuit Court records is available at the clerk's office during regular business hours. The Virginia Courts Case Information system provides free online access to case data. Standard copy fees are $0.50 per page, with certified copies requiring an additional $2.00. The city also maintains records through the Norfolk Circuit Court page at norfolk.gov/departments/circuit_court.

Norfolk also has a Records Requests page at norfolk.gov/5147/Records-Requests. This is the starting point for requesting city records outside the court system. Virginia's FOIA, found at Virginia Code Title 2.2, Chapter 37, governs public records access. Most government records are open unless a specific exemption applies.
